Terms of service
These terms apply when you use a website, app, browser extension or integration operated by 73 ("we", "us"), including 73.digital, webera.com, avanti.studio, the 73 Platform at app.73.digital and api.73.digital, and the 73 Platform browser extension (together, the "Services"). By using the Services you agree to these terms. If you use them for a company, you agree on its behalf.
1. Who we are
73 is the parent company of the Webera and Avanti Studio service brands, of the products DailyPulse, dooz, Loopable, Resilia and LifePulse, and the operator of the 73 Platform. Each product has its own terms on its website, and those apply to that product first. Where a brand sells you a service, a separate service agreement or order describes what you buy, its price and its term. If that agreement conflicts with these terms, the agreement wins.
2. The Services
- Websites describe what we do, publish articles, and let you contact us, ask for an estimate or take an assessment.
- The 73 Platform is our platform for managing relationships, leads and deals. It is used by our team and by people we invite. Access is personal; do not share your sign-in.
- The 73 Platform extension shows what the 73 Platform knows about the person or company on the page you are viewing and saves the professional details shown there. Only use it on pages you are entitled to view, and in line with the terms of the site you are on.
- Connected accounts. Some features let you connect a Google, Meta or other account. You authorise us to access that account only within the permissions you grant, for the feature you turned on, and you can revoke that at any time.
3. Your account
Keep your credentials secure and tell us at once if you think someone else has used them. You are responsible for what happens under your account. We may suspend an account that puts the Services, other users or third parties at risk.
4. Acceptable use
You must not:
- break the law, or infringe anyone's privacy, intellectual property or other rights;
- send spam, or use data from the Services to contact people who have asked not to be contacted;
- try to get into accounts, systems or data you were not given, or probe, scan or overload the Services;
- copy, resell or bulk-extract the Services or their data, or use them to build a competing product;
- upload malicious code, or content that is unlawful, deceptive or harassing.
5. AI features
Some features use AI models to summarise, match records, suggest next steps and draft text. AI output can be wrong or incomplete. Review it before you rely on it or send it to anyone; a person approves anything the Services send or publish on your behalf. We do not use your content or data to train AI models, and our AI provider's terms do not allow it to either.
6. Your content
You keep ownership of what you put into the Services. You give us permission to host, process and display it only to run the Services for you, as described in our privacy policy. You confirm you have the right to share it with us.
7. Our property
The Services, their software, design and the names 73, Webera, Avanti Studio and 73 Platform belong to us. These terms give you a limited, revocable, non-transferable right to use the Services while you follow them. Articles on our sites may be quoted with a link back.
8. Third-party services
The Services link to and work with services we do not control, such as Google, Meta, LinkedIn, Stripe and Amazon Web Services. Your use of those is governed by their own terms, and we are not responsible for them.
9. Privacy
Our privacy policy explains how we handle personal information, including data from Google and Meta APIs and how to have your data deleted. It forms part of these terms.
10. No warranty
Apart from what a signed service agreement promises, the Services are provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the Services will be uninterrupted or error-free.
11. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability arising from the Services is limited to the greater of the amount you paid us for them in the twelve months before the claim, or one hundred US dollars. Nothing in these terms limits liability that cannot be limited by law.
12. Indemnity
If a third party makes a claim against us because of how you used the Services in breach of these terms or the law, you will cover our reasonable costs of that claim.
13. Ending use
You can stop using the Services, disconnect any account you connected, and ask us to delete your data at any time. We may suspend or end your access if you break these terms or if we stop offering a Service. Sections that by their nature should survive (such as ownership, disclaimers and limits of liability) survive.
14. Changes
We may update these terms. We change the date at the top when we do, and tell account holders about material changes before they take effect. Continuing to use the Services after that means you accept the new terms.
15. General
If part of these terms cannot be enforced, the rest still applies. Not enforcing a right is not a waiver of it. You may not transfer these terms without our consent; we may transfer them to a successor of our business. These terms and any service agreement are the whole agreement between us about the Services.
